Terms governing text message communications through the Vortex Platform

3.1 Programs

  • Appointment reminders, insurance verification alerts, clinical follow-ups, account alerts, and marketing (opt-in only)

3.3–3.4 Frequency and Opt-Out

  • Typically 4–6 messages per month under standard configuration
  • Reply STOP, CANCEL, END, QUIT, UNSUBSCRIBE, or REMOVE to opt out instantly
  • Reply START or YES to re-subscribe; reply HELP for assistance

3.5–3.6 Carriers

  • Available on all major U.S. carriers; message and data rates may apply
  • Buildwick is not responsible for carrier charges or delivery failures

3.7–3.8 Compliance

  • All marketing messages restricted to 8 AM–9 PM in the recipient’s local time zone
  • National Do Not Call Registry honored and regularly scrubbed
  • Consent records retained for minimum 5 years
  • State mini-TCPA laws (FL, MD, OK, and others) also apply
  • Compliance is ultimately the responsibility of the platform customer

3.9–3.10 10DLC and HIPAA

  • All campaigns registered with the Campaign Registry (TCR) for 10DLC compliance
  • Standard SMS is not encrypted end-to-end; practices should avoid sending specific clinical details via SMS
  • Practices should obtain patient acknowledgment of SMS risks for PHI-related messages

3.11 Limitation of Liability

Buildwick shall not be liable for any damages arising from: (a) the failure to deliver SMS messages due to carrier limitations, network outages, or recipient device issues; (b) any charges incurred by recipients from their mobile carriers; (c) any claim arising from the content of messages composed or authorized by the customer; or (d) any TCPA, state law, or other regulatory violation attributable to the customer’s failure to obtain proper consent or to comply with applicable laws. The limitation of liability provisions set forth in the Terms and Conditions apply to all SMS-related claims.
